Overview

Ethan Rubin leverages his deep experience in the software field to provide the full spectrum of intellectual property litigation services to his industry clients. He regularly assists some of the world’s largest software companies with patent disputes, trade secret matters, and copyright cases.  

Throughout his career, Ethan has handled matters in U.S. District Courts, at the International Trade Commission, and before the Patent Trial and Appeal Board.  

Ethan’s clients rely upon his calm-under-pressure demeanor and the technical prowess he brings to complex software disputes. His extensive background in computer science enables him to quickly get up to speed on a range of complex systems, including computer networking and network security, digital image processing, data storage systems, and medical devices.  

In his pro bono practice, Ethan advocates for clients in need of political asylum and immigration representation through the Political Asylum/Immigration Representation Project. He received his master’s degree in computer science from Boston University and his J.D. from Boston College Law School.  

When he isn’t practicing law, Ethan can often be found at the local beach with his family.  

Experience

Represented a multinational toy and game company in a case at the ITC against 10 respondents alleged of infringing key technology related to gel blasters. Following pre-trial settlements with seven respondents, the matter resolved with a favorable initial determination.  

Adv. Qualcomm Incorporated (S.D. Cal): Represented defendant in patent infringement case relating to digital image processing. 

Bell Northern Research, LLC v. Huawei Device USA, Inc. (S.D. Cal.): Represented defendant in patent infringement case relating to power regulation systems and 3GPP networking standards. 

ARRIS Enterprises LLC v. Sony Interactive Entertainment (N.D. Cal.): Represented plaintiff in patent infringement case relating to content delivery in distributed networks. 

Advice Interactive Group, LLC v. Web.com Group, Inc. (M.D. Fla): Trade secret misappropriation and copyright infringement case relating to online visibility reporting and web crawlers.   

Pro bono activities 

Working with the Political Asylum/Immigration Representation Project, Ethan represented an LGBTQ woman who fled to the U.S. after suffering persecution in her home country due to her sexual orientation. He ultimately succeeded in winning asylum for the woman, enabling her to remain in the U.S. 

Named to the Massachusetts Supreme Judicial Court's Pro Bono Honor Roll for providing 50 or more pro bono hours in a single year (2019-2023).
