Overview

Tyler Train has extensive experience in intellectual property litigation across a variety of technologies, with an emphasis on patent litigation in the medical device and medtech industry. With a technical background in biomedical engineering, he helps medtech innovators protect and enforce their intellectual property.

Tyler has tried multiple patent cases to verdict, where he has experience taking and preparing witnesses and arguing trial motions. Tyler is also skilled at developing pre-trial strategies for patent-specific issues such as claim construction, non-infringement, and invalidity.

In addition to his litigation work, Tyler’s practice also encompasses post-grant proceedings and prosecution of patent and trademark applications both in the U.S. and internationally. Tyler serves clients in the fields of medical devices, semiconductors, and software and mobile applications, among many others. He provides IP counseling on matters such as patentability and prior art, and he has drafted and negotiated agreements such as licenses, IP transfer agreements, and non-disclosure agreements. This interdisciplinary approach to his IP practice enables Tyler to provide representation that supports and considers every aspect of the intellectual property lifecycle.

Outside of the office, Tyler volunteers on the executive board of DeviceAlliance, a non-profit medical device organization that provides networking and growth opportunities within the Orange County medtech community. Tyler has also volunteered doing pro bono work throughout Southern California, such as for the Union Rescue Mission on Los Angeles’ Skid Row and through the San Diego Volunteer Lawyer Program. 

Tyler moved to Orange County after law school, where he currently resides with his wife and son. He is active in the legal community around Fish’s Orange County office, where he organizes various networking and panel events throughout the year.
